AFFILIATE PROGRAM TERMS & CONDITIONS
1. Overview
1.1 These terms and conditions ("Agreement") govern your participation in the affiliate program ("Program") offered by Hoooolla Ideas Sdn bhd (“Company," "we," "our," or "us") for our Shopify website design & customization, theme updates and Shopif migration services.
1.2 By participating in the Program, you agree to comply with and be bound by these terms and conditions.
2. Enrollment
2.1 To participate in the Program, you must apply through our affiliate application process. We reserve the right to approve or reject applications at our sole discretion.
2.2 You must provide accurate and up-to-date information during the application process.
3. Affiliate Responsibilities
3.1 As an affiliate, you will promote our Shopify website design and customization services using unique affiliate links provided by us.
3.2 You may also submit manual referrals via live chat or email at info@hoooolla.com. The submitted information will be entered into the affiliate portal.
3.3 You will be solely responsible for your promotional activities, ensuring they comply with all applicable laws and regulations.
3.4 You must not engage in any form of misleading, deceptive, or unethical marketing practices.
4. Commissions
4.1 For each qualified sale referred by you through your affiliate link or manually submitted referral, you will earn a commission based on the terms outlined in our affiliate commission structure.
4.2 Commissions will be paid to you once customer’s payment has been received in full via the payment method specified in your affiliate account.
4.3 Commission payments are subject to adjustments for refunds, chargebacks, and cancellations.
5. Termination
5.1 Either party may terminate this Agreement at any time, for any reason, by providing written notice to the other party.
5.2 We may immediately terminate your participation in the Program if you violate any terms of this Agreement or engage in conduct that we deem harmful to our brand or reputation.
6. Intellectual Property
6.1 You are granted a limited, non-exclusive, revocable license to use our marketing materials solely for the purpose of promoting our services as part of the Program.
6.2 The marketing assets available in the affiliate portal may be used for promotional purposes, subject to the terms outlined in this Agreement.
6.3 You must not modify, reproduce, distribute, or create derivative works based on our marketing materials without our prior written consent.
7. Confidentiality
7.1 You agree to keep any non-public information obtained through your participation in the Program confidential and not disclose it to any third party.
8. Limitation of Liability
8.1 We will not be liable for any indirect, incidental, special, or consequential damages arising from your participation in the Program.
9. Governing Law
9.1 This Agreement shall be governed by and construed in accordance with the laws of Malaysia.
10. Changes to the Agreement
10.1 We reserve the right to modify, amend, or change any terms of this Agreement at any time. You will be notified of any changes, and continued participation in the Program constitutes acceptance of the modified Agreement.
By participating in our affiliate program, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
